the difference between a pirated game, and a used game sale, is that for every used game sale, there was a legitimate sale. someone had to trade it in, for it to be sold used.
so:
a sale is a sale.
a used sale, is half a sale.
a pirated sale is... what fraction of a sale?
granted SOMEBODY payed for that pirate copy. but what rights does that purchase convey? most wouldn't say it entitles you to copy it freely as many times as you wish and distribute it to everyone in the world at little or no cost to yourself... which is what pirating basically is..
so admittedly this whole debate falls within the shades of grey, but even just mathematically speaking, pirate copies are a darker shade.
(again ftr, i always try to buy games new. i own exactly 3 used games, which i only bought used because i couldn't find them new.)
so that's where my line is. if yours is somewhere else that's fine, your decision.... but you have to own that decision. you can't take the "low road" and then proclaim to be on the "high road" by rattling off semantics or blaming the creator for a less than ideal product. (if it's not worth buying, why is it worth pirating?)

it's not stealing, and I don't want to hear about the industries woes, the fact of the matter is that the industry is oversaturated, and people can easily get out their with the internet now and don't need the RIAA to back them, failed business model is failed business model. ***changes, companies need to realize this. Next you're going to tell me hollywood doesn't make any money.
If software piracy was nonexistent, you'd be able to buy D3 for 10 bucks - Also, DRM and all that crap wouldn't exist. We've pretty much all done it at one time, but it doesn't mean it's not stealing.

Piracy is more like inflation. It's not stealing, it's copying. Stealing implies the original is missing. If piracy is not stealing then you are saying that you can use anything you want to as long as you don't take a physical copy?
If that's the case then why are there multi-million dollar lawsuits going on daily over just that?
Piracy is not theft, it is the copying of bits. He's talking about a concrete definition, not the result or emotional appeal of words like "steal" and "theft".

So basically you guys are saying that anyone that wants to is completely entitled to "copy" anything they want to and use it with no consequence?
If so... Why do you feel anyone is entitled to anything for free when it is available by other means if it is not a necessity?
We're not saying anything. We're simply saying that piracy is not theft.
To steal means that you take something from someone else - and that something that you've taken can no longer be used by the one you've stolen it from.
Piracy, on the other hand, is like a duplicator machine. Your friend may have spent 10 years building a house - you bring your duplicator machine over and duplicate his house, did you steal his house? No, his house is still there.

You are giving companies way too much faith that they would no raise price strictly on demand and an imposed tightening of supply.
Look at oil/gas companies. The US alone can self sustain for several hundred years (more than enough time to find a viable replacement), yet we are paying nearly $100 for a barrel of crude oil and an unprecedented (and non congruent) AVG of $3.50 for gasoline at the moment. Trust me, this ridiculous pricing has nothing to do with theft. Companies People are greedy. Such as life.

I've been planning on picking up Torchlight for a while. It's done by much of the D2 crew, from what I understand. Torchlight 2 is coming out soon as well.
