Unfortunately, the costs incurred will be lost, but it's better to pay for a semi-decent lawyer then just take whatever the court system gives you. If you just go with what they give you, there's a good chance he'll get probation, which means fines and fees, probably more than the lawyer would have cost. Not to mention while on probation they basically just sit back and wait for you to screw up. It's all part of the revolving door system.
If/after the case is dropped, he can try a civil suit to sue the dude for costs incurred, but, even if he wins, the chances of ever seeing a dime of it are pretty remote.
