I think that's the funniest part in the whole case, is that they can't fire her since she was elected.
Can't they suspend her or something until she resigns? There was something about holding a special proceeding or something to remove her from office, but they cited the costs as being too high for something like that.

Bahamut.Baconwrap said: »On a side note, isn't she effectively refusing to do her job for religious reasons, a right not afforded to government employees? Why is she still employed?
Because she's an elected official so the they have three options: 1)Jail or Fine her 2) Impeach her or 3) hope she resigns.
I was under the impression that impeachment was a formality for commissioners. The people that work for her are simple employees and risk termination by refusing to issue licenses. Clear out her employees, unpaid suspension for refusing to perform the duties of their job, and see how fast everyone turns on her.

Can't they suspend her or something until she resigns? Not without a very costly impeachment process. Kentucky doesn't meet every year, and this is the off year of the legislative session.

I'm not sure about that. The majority of articles being posted are saying she needs to be impeached to be removed from office.
Q&A: Why hasn't Ky. clerk been fired in gay marriage license case?
Quote: Question: Why hasn’t Kim Davis been fired for refusing to issue marriage licenses and defying court orders?
Answer: She is an elected official and can only be removed from office for impeachment.
Q: How would she be impeached?
A: The Kentucky House of Representatives would have to charge her with an impeachable offense and the Senate would then try her.
Q: Is that likely?
A: The Kentucky Equality Federation, a gay rights group, has called for Gov. Steve Beshear to call a special session of the General Assembly to pursue impeachment. But Beshear, citing costs, has already declined to convene a special session to consider emergency legislation that would accommodate Davis and other clerks by having state government issue marriage licenses. Also, Bluegrass Polls show most Kentucky voters oppose gay marriage and support accommodating Davis. Beshear declined to comment Tuesday.

Jailing her is stupid, she should just have lost her job. She works for the government there is no loosing your job.

She can't be forcibly removed from office, but the commissioners should have the authority to suspend her pending a decision to impeach and most definitely have the authority to suspend or fire the staff. She can't do her job while in jail, appoint an interim office manager, etc.
It sounds like it's not the lack of tools at their disposal but rather fear of public backlash for oppressing her religious freedom.

Well she's in a jail now I wonder if her office will be granting licenses in the next few days.

If they don't, fire the lot of them. See how willing they are to be martyrs for her cause and how long she plays the victim when people who trusted her start losing their livelihood.

I think she's willing to loose her job and become martyred at this point. She can write a book and then go on the conservative political circuit giving lectures and never have to work another day in her life.

That's fine, but her employees aren't elected officials and aren't going to get book deals. Why aren't they subject to reprimand.
Why is the governor citing cost of a special session instead of considering the dozens of lawsuits that the state WILL lose?
Democrat is a political party, (social) conservative is an ideology.

That's true, didn't think of it that way. I think KY as a state opposes same-sex marriage still and many KY politicians simply don't want to be associated with supporting same-sex marriage.

Then let the record show they are opposed to enforcing the law and fiscally irresponsible.

Eh, Rand is already a pretty staunch supporter of individual freedoms and outright opposes a lot of existing laws.

Careful with your wording. You could scare some divorce lawyers with talk like that.

Divorce is for quitters. The right thing do is to take out your hatred of your other half with a drinking problem

But seriously though, they don't have to change one bit.
Latinas are perfect the way they are. No plastic surgery or bleaching of one's hair is needed >.>
It's all making sense now.
KN's found his voice about immigrants because he's got himself a feisty Latina.

So the clerk was offered an out of jail free card and declined.
She is on her way to jail and the deputy clerks will issue the licenses. Except for one, her son.
