I cant think of anytime I would use mana wall mp is to precious as is esp when I am planning on taking a hit. Maybe if I was a taru but even with 8/8 mp merits I cant think of wanting to waist mp like that, I mean that would normally be anywhere from a T4 down the drain to an AM II, unless I was zoning a mob that went baby Jesus on me.

The federal trial challenging Prop 8 in California had its closing arguments yesterday. We won't have a verdict for a few more weeks, but it appears to be going very well for the pro-gay-marriage side.

Regardless of the outcome, it will be appealed to the US 9th Circuit, and from there, most likely to the US Supreme Court.

What worries me is many members of the supreme court are very right wing -.-

That's good. Lets hope it officially goes through. I was pissed when NYC didn't pass. And what made it so bad was the majority of votes against gay marrige was from minorities. You'd think with so much oppression minorities have faced there would be a yes. But since many, like some members of my family, are more concerned about morality.....

I dunno I'm all for them having both Meteor and Aspir2, but that's just me :-P

For anyone that wants a summary of the Prop 8 case so far (apologies for tl;dr):

The case is Perry v. Schwarzenegger. The plaintiffs (the pro-gay-marriage) side are represented by Ted Olsen and David Boies. These are the two lawyers who represented Bush and Gore during the 2000 election fiasco. Former rivals, they've teamed up in support of gay marriage. Ted Olsen used to be Solicitor General under Bush -- the US government's chief lawyer before the Supreme Court.

The defendant is technically Republican Governor Arnold Schwarzenegger. However, both himself and the state Attorney General have declined to defend it. This means the defense falls to the religious and political groups that passed it in the first place.

The judge is Vaughn R. Walker, a Republican originally nominated by Ronald Reagan and later confirmed under George H. W. Bush. He is also openly gay. The trial is being held in federal court in San Francisco.

So far, the trial has gone very well for the pro-gay-marriage side, which called 16 expert witnesses. The anti-gay-marriage side called only 2.

The anti-gay-marriage side has been forced to concede in open court that:

- There is no rational basis of evidence to believe that gay marriage will harm children or the institution of marriage itself.

- The "point" of marriage is not necessarily procreation, or the encouragement thereof.

These were both major blows to their case. They also suffered a major setback when one of their two witnesses broke down under questioning and admitted "We would be more American on the day we permit same-sex marriage than we were on the day before."

Instead, they've been forced to fall back to the only argument they have left:


In other words, "we concede that there is no evidence to support our case, but we don't need any. Even if we're wrong, the decision is a cultural one and should be left to the people."

The pro-gay-marriage side has won a few major arguments:

- Marriage is not a privilege but a fundamental human right. The Supreme Court has said so already in Loving v. Virginia and other cases, which makes it established law.

- "Appeal to tradition" (the "it's always been this way" argument) is not a viable legal defense where fundamental human rights are concerned.

- It is not the role of government, and the state of California in particular, to "encourage" heterosexual procreation or behavior:

If Judge Walker in San Francisco ends up pro-gay-marriage, it will become legal again in California, for now. If he ends up anti-gay-marriage, it'll stay illegal for now.

Either way, it'll be appealed to the 9th Circuit, which must hear the case.

If the 9th Circuit (which is thought of as liberal, and is also in San Francisco) ends up pro-gay-marriage, it will immediately become legal everywhere within the jurisdiction of the 9th circuit: Alaska, Arizona, California, Hawaii, Idaho, Montana, Nevada, Oregon, and Washington.

If the 9th circuit ends up anti-gay-marriage, it'll remain as it is now.

Either way, it will then be appealed to the US Supreme Court.

However, if the 9th circuit ended up anti-gay-marriage, the Supreme Court can simply choose not to hear the case, letting the decision stand, and it's end of the road. Or they could choose to hear it. We don't know. Toss up.

If the 9th circuit ended up pro-gay-marriage, the Supreme Court will have to take the case, because they won't be able to let the decision stand where those ten states legalized it yet the rest of the country is in a weird hodge-podge of legal and illegal.

And from there, it all comes down to how the Supreme Court rules.

I myself never want to get married, but I would still love to know that I could if I changed my mind.

Mawage *sorry princess bride moment lol*, is a choice. There are benefits to it in the sense of unionization in terms of names and rights like, for example, medical and/or financial situations. But even if you don't want to get married its all good too because you can have about the same situation as i meantioned.

I would so love to hear that the 9th district goes pro-gay-marriage, but we'll see what happens :3
