You need to make the case that the accused to guilty of a crime beyond reasonable doubt and you use evidence to do that. The prosecution couldn't convince twelve people that Senator Menendez was guilty beyond a reasonable doubt and the defense couldn't convince those same jurors that he wasn't guilty. And since the jurors couldn't reconcile we get a mistrial which makes it extremely hard for the Prosecutor to win if they want to try for a do over. Trump never sexually assaulted anyone or if he did he never was sent to prison for it. Just because he was joking with a guy about grabbing pussy doesn't mean he did it.
