No one just sets explosives to kill people for the hell of it unless they're an unhinged sociopath. He's likely got some grievance and they're going to pummel it out of him.

We dont know if he is a functioning sociopath or not though. I would rather the facts be gathered first and THEN "terrorism" be thrown around because it then is definitely Terrorism and not just an act of violence.

No death penalty in Massachusetts. Under federal law terrorism cases are automatically federal cases. I don't know how state capital punishment laws apply to federal cases.

Terrorism is a catch-all buzzword that gets thrown around way too easily these days. It's not even a good word. Terrorism actually has specific definitions under law. People just use it to describe whatever they want.
Hence people calling all killings in the name of jihad terrorism (when they aren't all terrorism) and avoid calling crimes that are meant to terrorize terrorism.

Terrorism generally applies to attacks that are meant to cause panic at large in society. Generally mass murder is meant to terrorize. However there are some exceptions. Jonestown was mass murder, but not necessarily terrorism.

I don't know how federal law would apply to this specific case, but I don't see why terrorism requires a political slant.
Jonestown was meant as mass murder, but to kill a very specific subset of people. It wasn't meant to put the rest of society in fear.
We don't know Tsarnaev's motivations yet, but if he simply wanted to place bombs and hurt people I don't see why his attacks weren't designed to instill terror, especially with the types of weapons used. You don't need a politcal agenda to be crazy.

To interpret what the legislature meant to legislate, as long as the laws fall within the boundaries of the Constitution.

Their family has confirmed the influence of Islam, at least in the older brother. But at this point it's unclear whether the attacks were carried out in the name of jihad, or just some sick people.
