Well, strictly speaking they're out to get anyone who disagrees with them beyond a certain point.

I mean, they're not going to knock your door down because you prefer Trident Spearmint to Juicy Fruit.

If they had been convicted of crimes, sure. A large percentage of people that were sent to Gitmo were released without charges.

But that logic (can't attack while in jail) can be applied to every person on the planet.

Legislative gridlock and politicking is generally why the Executive branch has power creeped in addition to numerous 'military engagements' that can't wait for Congress to make up its mind.

Much of Congress rather the heavy lifting be done by the POTUS so they can then claim they had nothing to do with it. Party affiliation means nothing. Win/win for pols.

Remember that Iraq vote? How that came to blow up in the faces of those who voted yes? Yeah, people learned.
